NTC imposes anti-dumping duties on China, South Africa imports

March 14, 2023 (MLN): In a landmark decision, the National Tariff Commission has imposed definitive anti-dumping duties on imports of Color Coated Coils/Sheets originating from China and South Africa.

The decision comes after the Commission's affirmative final determination in accordance with the Anti-Dumping Duties Act, 2015.

The duties, ranging from 5.36% to 10.88% for China and 14.24% for South Africa of C&F value in ad valorem terms, will be in effect till June 12, 2023. However, in accordance with Section 58(2) of the Act, the duties may terminate on the aforementioned date, provided a review under Section 58(3) of the Act is not initiated before the termination date.

Domestic industry producing Color Coated Coils/Sheets have been given the opportunity to file a sunset review application with the Commission on the prescribed form within forty-five days of the publication of the notice. The application form can be obtained from the Commission.

This decision marks a significant victory for the domestic industry, which has long been struggling to compete with unfairly priced imports from China and South Africa. The imposition of definitive anti-dumping duties will not only level the playing field for the domestic industry but also promote fair trade practices.

The news has been welcomed by industry experts and stakeholders, who believe that this decision will not only safeguard the interests of the domestic industry but also ensure a level playing field for all players in the market.

With the deadline for the termination of duties fast approaching, all eyes are on the Commission to see if a sunset review application is filed, and if so, what the outcome will be.

For the unversed, sunset review is a technical word for the review by NTC after 5 years of its imposition.
